• Multi-language support and global communication capabilities
• Real-time analytics, call transcriptions, and sentiment analysis
• Integration with existing business systems and CRM platforms
• Call recording and data processing services

3. Account Registration and Security

To use certain features of the Services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials and API keys
• Notify Osmosian immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account
• Use the Services only for legitimate business purposes

4. Subscription and Billing

4.1 Subscription Plans: Osmosian offers various subscription plans (Starter, Professional, Enterprise, and Custom). The features, call limits, and pricing of each plan are described on our pricing page.

4.2 Payment: You agree to pay all fees associated with your subscription plan. Payments are processed securely through our payment providers. All payments are non-refundable unless otherwise specified in our refund policy.

4.3 Billing Cycle: Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Usage charges may apply for exceeding plan limits.

4.4 Changes to Pricing: Osmosian reserves the right to change its pricing at any time. Any price changes will be communicated to you at least 30 days in advance.

4.5 Suspension for Non-Payment: Osmosian may suspend your access to the Services if payment is overdue. Services will be restored upon successful payment.

5. AI Service Limitations and Expectations

5.1 AI Technology: Our AI phone agents use advanced machine learning technology but are not perfect. You acknowledge that:

• AI responses may occasionally be inaccurate or inappropriate
• AI agents may not handle all types of conversations or emergency situations
• Human oversight and escalation procedures are recommended
• AI performance improves over time through machine learning

5.2 Service Availability: While we strive for 24/7 availability, we do not guarantee uninterrupted service. Scheduled maintenance and unexpected outages may occur.

6. User Content and Conduct

6.1 User Content: You retain ownership of any content you provide to the Services ("User Content"). By providing User Content, you grant Osmosian a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, and process such content for the purpose of providing and improving the Services.

6.2 Call Data: Call recordings, transcripts, and related data may be processed and stored to provide Services, improve AI performance, and ensure quality assurance.

6.3 Prohibited Conduct: You agree not to use the Services to:

• Violate any applicable laws or regulations, including telecommunications and privacy laws
• Engage in spam calling, robocalling, or unsolicited marketing without proper consent
• Infringe upon the rights of others or transmit harmful content
• Attempt to gain unauthorized access to the Services or reverse engineer our technology
• Interfere with or disrupt the Services or other users' access
• Engage in any fraudulent, deceptive, or illegal practices
• Use the Services for emergency services or life-threatening situations

7. Compliance and Legal Obligations

7.1 Telecommunications Compliance: You are responsible for compliance with all applicable telecommunications laws, including:

• Obtaining proper consent for call recording where required by law
• Complying with do-not-call registries and opt-out requests
• Following regulations regarding automated calling systems
• Adhering to data protection and privacy laws (GDPR, CCPA, etc.)

7.2 International Use: If you use our Services internationally, you must comply with all applicable local laws and regulations.

8. Intellectual Property

The Services, including all content, features, functionality, AI algorithms, and software, are owned by Osmosian Tech Private Limited and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Services without Osmosian's prior written consent.

9. Data Protection and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data and the data processed through our AI phone agents. You are responsible for ensuring you have the necessary rights and consents to process any personal data through our Services.

10. Limitation of Liability

To the maximum extent permitted by law, Osmosian shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Services, even if Osmosian has been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be error-free, secure, or continuously available.

12. Indemnification

You agree to indemnify, defend, and hold harmless Osmosian Tech Private Limited, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

13. Termination

Either party may terminate this agreement with 30 days' written notice. Osmosian reserves the right to suspend or terminate your access to the Services immediately for violations of these Terms. Upon termination, your right to use the Services will immediately cease, and we may delete your data after a reasonable retention period.

14. Force Majeure

Neither party shall be liable for any failure to perform due to causes beyond their reasonable control, including but not limited to natural disasters, government actions, or telecommunications failures.

15. Changes to Terms

Osmosian may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and sending notice to your registered email address. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh, India.
