Refund and Cancellation Policy

This policy outlines the terms and conditions for refunds and cancellations for our AI calling services provided by Osmosian Tech. By using our services, you agree to these terms.

Service Description

Osmosian provides AI-powered phone calling services, including automated customer support, appointment scheduling, business communication solutions, and related technology services.

Subscription Services

Monthly Subscriptions

Can be cancelled within 2 days of activation, provided the services have not been substantially used (no significant call minutes, API usage, or core features utilized). After 2 days, cancellation will be effective at the end of the current billing cycle with no refund for the remaining period.

Annual Subscriptions

Can be cancelled within 7 days of activation, provided the services have not been substantially used (less than 5% of allocated resources consumed). After 7 days, cancellation will be effective at the end of the current billing cycle with no refund for the remaining subscription period, except in cases of service non-delivery as specified below.

Enterprise Plans

Custom cancellation terms as per individual contract agreements.

Refund Eligibility

Service Interruption

Partial refund may be provided if our services are unavailable for more than 24 consecutive hours due to technical issues on our end, subject to verification.

Service Non-Delivery

Refund considered within first 7 days of subscription if core service functionality is not delivered as explicitly promised in our service description.

Billing Errors

Full refund for documented billing errors within 30 days of charge, subject to verification.

Non-Refundable Items

• Usage-based charges: Minutes used, calls made, SMS sent, or API calls executed

• Setup and onboarding fees: One-time configuration, training, and integration costs

• Customization services: Custom AI voice training, specialized integrations, or bespoke development

• Third-party costs: External API charges, telephony carrier fees, or integration platform costs

• Services substantially used: Subscriptions where significant usage has occurred (20% of allocated resources)

• Change of mind: Refunds not provided for business decisions or preference changes

Refund timeline

Once the refund request is approved, the refunded amount will be credited to your original mode of payment within 5-7 business days.

Cancellation Process

How to Cancel

• Online: Through your account dashboard
• Email: Written request to info@osmosian.tech
• Processing Time: Cancellations effective at end of current billing cycle

Required Information

Account details, reason for cancellation, and preferred effective date must be provided.

Refund Processing

Processing Timeline

Approved refunds will be processed within 7-10 business days from approval date.

Refund Method

Refunds will be credited to the original payment method used for the transaction.

Partial Refunds

When applicable, calculated based on unused service period minus any usage-based charges.

Service Limitations & Liability

No Refunds For

• User error, misuse, or failure to follow service guidelines
• Compatibility issues with third-party systems not disclosed during setup
• Force majeure events including natural disasters, government actions, or internet outages
• Issues arising from customer's network, hardware, or software configurations
• Suspension due to violation of terms of service or acceptable use policy

Liability Limitation

Our maximum liability for any claim is limited to the amount paid for services in the month the issue occurred. We are not liable for indirect, consequential, or business losses.

Dispute Resolution

Internal Resolution

All refund requests and disputes must first be submitted to our customer support team for internal resolution attempt.

Legal Jurisdiction

All disputes will be resolved according to Indian laws and regulations. Legal proceedings will be conducted in Indore, Madhya Pradesh, India.

Policy Updates

We reserve the right to update this policy at any time. Changes will be communicated via email and website notification. Continued use of services after policy updates constitutes acceptance of the revised terms.

Important: This policy complies with Indian consumer protection laws and payment gateway requirements. All transactions are processed in Indian Rupees (INR) and subject to applicable taxes.
